Any legal advice?? Please.. This is regarding two contracts and a Scam modeling agency that wants to screw me?

Postby toryn34 » Tue Jun 12, 2012 4:52 am

I signed two contracts with them. The agency contract that's titled "urban talent" which is the agency that I signed with. Now this contract basically says that I'm being represented by them and blah blah.. Also somewhere on that contract it says that as part of their services Ivan negotiate, renegotiate, any and all documents, contracts, an agreements.

Now on the second contract, it is titled "style incorporatedl" and it's basically a contract that says for their services I will pay 1700 dollars for their training and photoshoots.. ( this is second conpany that i wasnt aware lf that is supposedlu in charge of the training and photoshoots and money handling by the way) and basically this contract says that it CAN NOT be cancelled, even with a 72 hour provision period ( which is basically a law that can allow you to cancel a contract winin 72 hours)... Anyways it cant be cancelled or refunded, and I was not aware or told that until I read the copy of the contract... I had no clue whatsoever. And if I would have known that or told that I wouldn't have signed the contract in the first place... Yet I wouldn't even be trying to cancel the contract if I would have known that.

Anyways I signed 2 days ago. I just decided that I don't want to be apart f their company because from reviews I've read online they're pretty shady. And they're not a legitimate professional company and I just heard they had a lawsuit against them a couple years ago.... Anyways..

Both contracts say that they can be changed if done in writing by both parties... I've asked her if I can change both contracts and she said no...

If they were a legit company they wouldn't be fighting and forcing me to be with them and pay 1700 dollars.

This lady said I have no other option but to pay the 1700 and be in their classes...

But this is my point... I don't want to be with their agency, I will not be paying for classes ands photoshoots that I will not be receiving..,

What do I do??? Legal advice please..

I'm thinking of calling an attorney and getting his opinion

Positive feedback only please. I'm only 18 and have never signed a contract before,, it was in the spur of the moment and the lady rushed me into it.., they have no proof that I was even financially able to pay them when I signed...

And they're threatening to send me to collections:...

You entered into a contract to pay them $1700? If it is a valid contract, they could likely try to enforce it. You might just want to make yourself scarce. Maybe there is a clause that you have 3 days to cancel or something. Look it over closely.

Please, "anyways" is not a word. Just say "anyway."

Don't pay them.

They will yell and scream and threaten and carry on like 2 year olds. But the law is on your side.

First, as long as you don't pay them, then they have to take you to court. They don't want to go to court, because they will lose. And because they don't want their business practices to be exposed to a judge.

Second, their contract is illegal and would never be upheld by a judge.

They will do a lot of threats, but just ignore them.

You ability to cancel depends on WHERE the contract was signed and WHERE you met and discussed things with them.

The Federal Trade Commission "Cooling-Off Rule" allows you to cancel a contract when you purchase something AT YOUR HOME OR AT A LOCATION THAT IS NOT THE PERMANENT PLACE OF BUSINESS FOR THE SELLER.

In short, if they came to your home, then you have the cooling off period, if you went to their office, you don't.

If you are going to contact an attorney, you better do it soon, remember you only have 3 days, and you signed the contract 2 days ago, so you may already be outside the time period.

Anytime anyone wants to rush you into something, it's because they're hiding something.

Unfortunately, you may be stuck with paying them based on the information you provided. However, contacting an attorney is not a bad idea, and you may want to find a good one immediately to see if you can somehow get out of paying. Typically, short of intentional misrepresentation or some other type of fraud or illegality in inducing someone to sign a contract, parties are bound to the terms of their contracts and required to perform as stated. It's where the old saying "buyer beware" comes from.

If you were under 18 when you signed the contract, you can void it at your discretion. Minors generally can only be bound to contract for necessities (e.g. shelter, clothes, food). That's why parents are required to sign contracts for their children. It's a precautionary measure to ensure the child doesn't void the contract and to ensure the child isn't being taken advantage of. If you were still 17 or under when you first signed the contract, you can use this defense to get out of it.

Otherwise, again, short of fraud or illegality, you might be out of luck and stuck in the contract. However, contact a lawyer to see if there's anything more you can do.
