Dear Gary,
1. First, you must do your homework and document the replacement cost, which can usually be done easily on the Internet using Kelley Blue Book(http://www.kbb.com/) AND
National Automobile Dealers Association(http://www2.nadaguides.com/). Also, find and print out classified ads in your geographical area showing similar cars/mileage/condition and what they are selling for via private party and dealer;
2. Negotiate with the insurance carrier based on your research;
3. If they say know, tell them you are hiring an attorney to represent your best interests!
Was anyone injured? You probably should consult with an attorney no matter what you decide!
