Can a personal injury case take this long?

Postby larenzo » Fri Apr 01, 2011 3:10 am

I'm involved in a personal injury case where the accident occur ed in August 2005. It still is not settled. A law suite has been filed but no trial. Is this at all usual?

It is somewhat unusual that you have no trial date set. It is not unusual for any type of civil case to drag on for years. Once your lawsuit was filed, your attorney should have been given a trial schedule. This would provide a specific list of dates that different things had to be done (discovery, disclosure of expert witnesses, pretrial motions, etc.). Trial schedules are often amended to push the trial date out, but your attorney should absolutely have the date your trial is currently scheduled for.

It sounds as though you need to schedule an appointment with your attorney to find out exactly where your case is, and when your trial is scheduled to begin.

Apparently they can. Your case is still going on.

This would be a good question to ask your attorney. He's the one that knows all the details of your case and the venue where the case was filed.
