Can I be differed from donating plasma due to someone's claim that I have a medical condition?

Postby seager » Mon Jan 02, 2012 2:17 am

I have been donating plasma for 4 years now, and over the last 2 years I have kinda gone back to blood as I had a good paying job.
I went in today to signup again as I am jobless and need the money. During the process I was told I was differed due to someone claiming I have a medical condition!
They put me on the deferral list for the state as well and said I need to prove that I do not have the condition. The test costs well above $2,000 and currently I am jobless, which is why I wanted to donate again rather than donate blood.

So my question is, is this even legal?
They can actually ban me based on what someone else claims?
So with this logic I could go in front of the building, and get peoples names, then walk into the building and claim they all have AIDS, or some blood clotting disorder? and they all will be banned until they can prove it otherwise?
What should I do about this? When I brought that point up to the medical person, she walked out of the room, and 2mins later she came back in and said I have to leave the building "now".
I have sent an email to the company and their parent company but is there any legal action I could possibly take? I was thinking slander on the person who reported. But that person made a mistake. But what about vs the company?

Also the company in question is Bio Life, owned by Baxter US.

That firm is an independent. They don't NEED your donation. They can pick and choose who they want. No different than trying to apply for a job. Maybe 20 good choices so the employer "pulls straws" and one person gets the job. It was not you. That is Life.

I bet you made an error by mentioning the word "AIDS" That is why you got the boot.

For someone else to make a claim about your medical condition, they would need to know intimate things about you. (Generally only your doctor knows that.) So, the claim made by the person would be groundless and carry no weight. The company knows that legality right off before they opened the doors on Day one. Maybe by your own words, you confirmed it. They definitely are not going to take a chance on you at that point.

If you cannot afford the medical test, you certainly cannot afford a lawyer to sue either the person who told the story about you or the company that takes blood. They are not required by any law to accept your blood, especially if you are being paid for it. If you are paid for your blood, it is not a donation. The whole thing sound very odd.

They have every right to limit their donors and it could be because they didn't like the color of your socks that day. They have the right.

They have to be very picky and don't exist for your benefit.

They are REQUIRED to refuse donations of blood products if they have reason to believe your blood may be contaminated. You were NOT placed on a deferral list because someone CLAIMED you had a medical condition. You were most likely placed on the list because some that TESTED positive for a communicable condition stated that they had been in sufficiently intimate contact with you to transmit the condition. Also note, there is no STATE deferral list. You are on the Red Cross NATIONAL deferral list.

As a regular platelet donor, I an offended by referring to SELLING plasma as donating.
