By not allowing me to exceed a certain limit of data usage before cutting my speed, aren't they in fact limiting me? How is that unlimited?

Nope.jpg Next time you should read the part of the contract where they state they can slow your speed if you are stressing the network or during peak hours.

What does your contract say? I'm with T-Mobile, and they have a similar plan. Right in the contract, it specifically states that after a certain amount of usage, the speed slows down. You still have access, just at a slower speed.

So no contract violation occurred. "Unlimited" does not mean a constant speed.

Check whether they have stated in any part your contract where they state they can slow your speed if you are stressing the network or during peak hours. It would be a good idea to discuss it with a lawyer. While there are an abundance of lawyers for you to choose from in each state, choosing the right lawyer can make the difference between a successful or failed outcome in a class action case. No you cannot sue the company for reducing the speed as Supreme Court decision in 2011, upheld a company's right to include a clause in contracts prohibiting subscribers from suing the company as part of a class action. You should read your contract, it's clearly mentioned.
