You should consult with a lawyer. California is a community property state, so it may complicate things being married.

you can, but you can file only chapter 11 if your income is higher than median income in the state, otherwise you may file chapter 13

Yes, you can file the chapter 11 bankruptcy. You are qualified to file for bankruptcy because you are qualified to file for bankruptcy.
