Can My Ex Make Me Let Him Claim Our Kids On His Income Tax?

We have been divorced 4 years. There is no specification in our divorce decree about who claims kids on taxes. We have joint custody, but they are with me primarily. He pays child support and gets them every other weekend. He wants to take me to court to be able to claim at least one child(we have 2) on his taxes. Can he do this?

1) Your ex-anything can't "make" you do anything. 2) "Wants to take to court" = "strong-arming." 3) What was answered here earlier was to claim the child as a deduction and merely be first. 4) Therefore, claim the deduction and never mind the law court threat--let the IRS decide this one because that is their job.   danielpauldavis 27 months ago

No, your ex cannot MAKE you let him do anything. If the kids live with you, and you primarily support them, YOU get to claim them, not him.
