Car accident who's at fault?

There is a 5 lane road, the center lane is a left turn only lane and is turning into a shopping center, it will cross two lanes of oncoming traffic at an intersection. I am in the turning lane getting ready to turn left approx. 3 yards from light, Traffic to my right is stopped at the light. Two cars stop on the right to let a woman pull out who is making a left turn which will cross in front of me. They wave her into the lane i am in i see her coming and stop and she speeds up and hits me head on because she turned left into the turning lane to avoid side swiping traffic coming from her right (which is where she is wanting to go) she failed to look and allowed another persons judgement to affect her driving. The man who waved her over tells the police officer he did not see us coming because we were beside him in his blind spot. My car is totalled and hers barely has a dent. I had insurance but the police officer would not let me talk to her or get any of her information. She glared at me the intire time and didnt even ask if we were ok when she smashed into my car. The officer said we were makeing a legal turn and in the right lane. He also stated she was making a legal turn but relied on someone to wave her into traffic and instead of waiting she floored it and slammed into us. He wouldnt say who was at fault but i need to know if i need to get a lawyer. I also did not see her get any information from her glove box which makes me think she did not have insurance, which in alabama is the law. But why wouldnt he have issued her a ticket for no insurance?

It appears from your description that you were not at fault, especially since you stopped.

When the police report is finished, you can get a copy. It will have all her information and the facts of the accident. It isn't the officers job to assign blame, only to report the facts and issue tickets if any laws were broken.

No, you don't need an attorney unless you feel some compelling need to give away about a third of what you are entitled to.

Just make a report to your insurance making sure they have a copy of the police report, and follow their advice.

If for some reason the other insurance decides to not accept blame, then you can come back and ask the attorney question.

In Alabama they have a data base with insurance information that law enforcement can access, so she didn't have to dig in her glove box for the insurance card.
