Chapter 7 Bankruptcy

Postby Cadwallader » Wed Jun 18, 2014 2:39 am

my bankruptcy was dismissed because my attorney did not file the counseling certificate with the petition.  My attorney filed a motion that it was his error not the debtors, they did have the certificate.  How long does to take to hear back on the decision?

This type of motion is usually always approved by the court as long as you completed the credit counseling before the case was filed.  You should know something within a few weeks.  I can't give a definite amount of time because everything depends on how many cases a judge has and how quickly the judge enters orders.
