Co Signer Information Rights

Postby Geron » Mon Jun 23, 2014 2:29 am

I co-signed my daughters school loans and she defaulted.  However, I was never notified by the school that there was a problem of any kind.   It is not in collection and the collection agency has felt free to be in communication...

my question is, does the school have any obligation - legally- to reach me, send a letter, or attempt to collect from me before it goes to collections?

I called the school and they say they cannot pull it back from collection(which I know is untrue)...I am looking for some leverage.

thanks,

Tawn

Tawn:   Unfortunately, no, the aren't prescribed to notify you before placing the debt with a debt collector.  They probably did so via your daughter, the actual maker.             Apex Credit Services, LLC             http://www.apexcreditservices.com
