Condominium - Leaking Pipe Above Threshold: Who's Accountable?

Postby Fane » Mon Jun 23, 2014 9:33 pm

There have been 2 situations of water trickle in the roof in my own toilet. the very first one happened on 8/16, that was the result of a dripping tub water-pipe in the residence unit above mine. I named residence maintenance team plus they created a pit on my roof to look at exactly what the issue was and determined it?s in the upstairs tube. Donald (operator of residence product above mine) named his insurance provider along with a plumber to repair the tube. the 2nd event occurred on 8/18, that was brought on by the exact same tube (following the repair was completed from the plumber Mark employed). Donald named his plumber again and changed the whole tube this time around. From these two situations, my roof was seriously damaged and my wood floor on my toilet was broken. Additionally, I'd to make use of my towels to hide the water. Mark?s insurance provider stated that they?ll just purchase repairing the pit about the roof. Sadly, I didn?t have homeowner?s insurance on my device. Who's accountable for the problems on both of these situations? (I reside in Va)

Condo - Leaking Pipe Above Ceiling: Who Is Responsible?

Postby Joben » Tue Jun 24, 2014 2:08 am

No one - until a court rules on it.
Obviously there's a good argument that Dave is responsible and if his insurance won't pay that's his problem. But I'm guessing he will not volunteer to cover your damages.

Condo - Leaking Pipe Above Ceiling: Who Is Responsible?

Postby Elki » Tue Jun 24, 2014 10:55 pm

Hae:Their insurance provider was stating he
Employed the plumber (thus not negligable). How
do I create a disagreement against that? That you don't. And the term is "irresponsible" which Mark is not. Within the first event a concealed tube released. He'd no method of understanding it would occur therefore no method of having the ability to avoid it. While it occurred he employed a plumber to repair it. The plumber first got it wrong. This is the plumber's neglect, not Jesseis. Feel free to-go following the plumber for that area of the harm that happened after his work. Hae:However, I didn?t have
homeowner?s insurance on my device. Yes, that truly is sad. And that Iam sure you will have a very good reason why you did not purchase it.
