Credit card company suing! HELP!?

Im 26 and so is my finace. He is retired from the military and receives only a fixed income. He was rated at 80% so he isn't 100% disabled BUT is missing a leg. Before he got hurt he incurred alot of debt. He had been paying it off only paying the minimum because of his fixed income but was making monthly payments. Well (before the credit card laws went into affect) the interest was jacked up big time and they wanted $700 a month payments (the debt on the card was about $8,000) so he couldn't afford that and wasn't paying them what they wanted or woasn't making payments period! So he called the company begging them to lower the inerest rates because there was no way he could pay it and they would not work with him. Well, now they are suing him. PLEASE tell me what is going to happen to him now!! All my life I have never carried a balance and have done everything to make sure my credit would be as good as possible and it is...I had it checked and my rating is EXCELLENT. He hadn't told me about this until it came this far, I knew he had the debt but thought he had it under control. I can't marry him until this is cleared up. Will he have to file bankruptcy? I don't want this affecting my credit! HELP I need answers! Thank you!

(And I know he is an idiot for letting this happen and it's his fault, I say if you don't have it don't spend it)

He can file bankruptcy and it won't affect you.
Also, it sounds like he's collecting a disability pension ... so, his pension probably can't be garnished.

If I were in his shoes, I would show up to court and let the judge see what fools the credit card company is being.

If you marry him, his credit does NOT effect your credit. The remain separate.

Bankruptcy is an option but it's not practical to file for only $8000. Does he have other debts?

Call the credit company, they may be willing to negotiate a settlement. Remember that half of America is in the same situation and that your negotiating position is strong in that you simply can't pay anymore. They're not going to get any more if they sue but they might get something if they settle plus the courts are clogged with such cases, the judge's sympathy will not be with the credit card company unless of course they contribute to his election campaign.
