Credit Card Debts In Oklahoma

Hi there, I live in Oklahoma. I have 5 credit card debts that I haven't pay in 4 months. One is chase - 32K, bank of america for around 30K, american express - 4k, citi-5k, at&t universal - 8K. The total debts are 77K, it probably is well over 80 by now. I have a discovery card which has a balance of 4K and it is still current and I have no plan to quit paying.

I have a mortgage with my wife on my house. My question is how long will the debts became judgment and put a lien on my house? The debts are all in my name, not in my wife's. If I Quitclaim deed the property to my wife, can they still put a lien on the house? I'm planning to sell the house by the way because of all these problems.

I can't tell you how long it will be before they get judgments. There isn't any way to know that in advance. I wouldn't worry about selling the house or getting liens against it. Now is a horrible time to try to sell a house. What you need to learn is how to deal with these problems in an effective and realistic way. Here you are already surrendered to the fact that they will get judgments and put liens on your house. Learn how to deal with debt collectors and make them pay you to go away and leave them aloneinstead of you paying them. Thank you so much for your answer, Mr. Bauer. I live in Oklahoma City too. Maybe we can meet sometimes. I did not know about the conference call until now, I make sure to make it on the next one. The thing with my house, I've got a contract for the house on Friday and it is at the title company. The buyer is putting 30% down so I'm not worried about his loan. What worries me though, we have 1 month until closing and the name on the house are both me and my wife. I haven't pay my credit cards since october 2008 and all the cards are in my name. If I transfer the title to just my wife's name, they cannot put a lien against the house, right?

That's not the way to go. If you try that they could claim that you did it to hide your asset from your creditors and it would not be hard for them to get the sale overturned. I'm glad you answered here because I did not hear you well on the phone a while ago. Now I understand your problem and what it is that you are worried about. Frankly, there is little or no possibility that they could get a judgment and a lien on the property in the length of time they would have left before the sale goes through. But that is the least of your worries. You need to start learning how to fight those potential judgments and win because they will happen. You will want to learn how to protect the proceeds from the sale of the house if any is left over after the mortgage is paid off and most certainly if you own the house free and clear.
