Custody and visitation?

Postby philibert63 » Tue Nov 22, 2011 7:42 pm

Well my daughters mom has a strong alcohol and drug history blah blah blah.. I don't even have a record except for when i was under 18 for pot. Other then that.. I have had my daughter since the break up Nov 2010. Daughters mom finally got sentenced when she committed her second OWI in 2009.. She just got sentenced recently.. It said on her conviction letter she has to do 30 days in jail. 515 days of global monitoring, 6 months probation. She has a battery charge still pending of january 2011 for assaulting my mother. She pleaded not guilty on that, not sure why when we have all the evidence and such. Maby she can get in trouble if she pleads guilty to battery charge?
I found out she was actually in a prison and only had to do 12 days there and gets out monday this upcoming one. Due to having 3 days credited. Big mess of stuff .... Already went to my Domestic relation /mediation. My concerns were that my daughter see her mother only supervised visits and That I want full custody. I feel it be safer and the best interest that she stays with me.
Any comments on all of this. We have not went to court for custody and we were never married. I have not let her see her daughter since she was arrested for assaulting my mom when she was on something again. Its been 4 months and we don't go to court till June or July. We are suppose to go to court back in march but my lawyer went on medical leave. Now the lawyer that specializes in family law in the same office had agreed to take all of his cases. Court is set for June 20th and my lawyer is booked that day. So they are going to have it continued also. Custody process is a pain and is stressful. But it is all worth it for my little girl that is 2 years old! Please comment what you think about this also last she does have a history of cps cases and a battery charge to her son for biting him. Passed all that and still has parental rights.. Big story about all that!!
THANKS

Chris

Custody and visitation?

your intentions are correct but you have to go about it the right way. You need to talk to your lawyer. and go to court and get supervised visitation set up. There are people out there that get paid to do that.

I don't think your daughter is safe with her mother either. If you don't ask the questions, you won't get the answers you need.

I agree the custody process is a pain in the butt. But good parents endure it because it's best for the child. Hang in there you'll be all right. Call your lawyer Monday.
