Hello everyone.I am unsure this really is within the proper forum but I'll give it a go. My ex-girlfriend and I've a 6-year old together. We actually have no legal custody contract in position for the child. Our child lives with her mother and I notice occasionally during the night and on the breaks. I presently reside in Staten Island in addition to my ex and my child. Our child presently would go to college in staten Area too. <br />
Our Ex simply approached me and suggested me that she's likely to progress to Monticello NY. She didnt provide any cause why and simply stated she was shifting. My ex has family up there that she'd be sticking with and she presently doesn't generate<br />
I've a problem that I wish somebody could answer for me personally. I'd prefer to learn if she may transfer without my permission 3 hours away? This would be an excessive difficulty for me personally since she's to date away and my visitation with my child would be severely damaged. Probably the case--- NY form  LDSS 4418 properly completed and filed is the critical step --and thats probably a required step for a birth certificate with your name on it ..unless the terms are used interchangeability --beyond me--check to be sure.

Did you signal an acknowlegment of paternity?  If so,  you've equivalent privileges regarding the child whilst the mom.  Each state has particular needs for moving with a child and the process required to be able to do so (usually, if additional guardian dooesn't acknowledge- need authorization of the courtroom).  You need to consult with local advice regarding that procedure.

yes im going to hire a good laywer.One other question, if my name is on the birth certificate does that mean that I have signed the acknowledgement of paternity considering that a birth certificate is an offical document ?

NO.  Absent a court order, mother has complete custody.  Recognizing paternity gives you little.  Merely a court order gives you real and lawful custody or visitation rights.  At this time, she does not need certainly to let you begin to see the child.  The paternity verification increases the assumption that you're the daddy but you were not committed therefore it is not conclusive.  Consult an attorney.

Yes- if your name is on the birth certificate as Father- then you signed an acknowledgment.
