Debt Collection/bank Account

Postby vemados » Tue Apr 15, 2014 3:21 am

I received a summons and complaint from Spotsylvania., Va. court.

The plaintiff, Unifund CCR Partners Successor by Assignment of Citibank South Dakota, N.A.  The account referred to Glasser and Glasser, P.L.C.  I returned within the 21 days given by the court a pleading in writing(as best I could as I know little about the law).  The summons said "appearance in person is not required by this Subpoena.  I have heard nothing until today.  The lawyers office called and asked my address and if I had a bank account and where and asked payment on the account.  After the call I began to worry.  Can they take money from my account without me hearing anything from the court.  Will I know what the court decides?  There was no date for anything given in the papers - only that this was a summons and I had 21 days to answer.

Debt Collection/bank Account

They normally will not take money from your account until they get a judgment but if you gave them bank account info they may. Never ever give out this info to a creditor or collector. Until you find out what is happening with your case keep the balance low in your checking or savings account. Follow up with the courts to get a status of the case and try to negotiate a payment plan with the attorneys office. Don't agree to more than you can afford and if they put you at risk talk to an attorney about bankruptcy or contact a consumer credit counseling service. Don't let them take food off your table or cause you to not be able to meet your basic living expenses. If you are successful in negotiating a plan never pay by check or check by phone. Pay by money order only. Do not give them access to your bank account.
