Defamation of character and wrongful termination?

Postby fitche » Tue Apr 05, 2011 11:10 pm

Okay I was in question about conspiracy to commit a crime, in exchange I became an Confidential Informant. Law enforcement assured that my indentity would remain private. Upon completion of the investigation the PD contacted my employer whom is a retired police officer. I was released from my job based on the information they recieved. My boss called a meeting at work and disclosed what law enforcement told him and included that I was a bad person and should be avoided. He gave details to my coworkers about the case. I cannot disclose details about the case but my part as a CI had nothing to do nor affected my job. Do I have a leg to stand on in sueing my previous job for defamation of character and wrongful termination. Also, sue the the local PD for revealing my identiy and endangering me and my family. After all I did sign a CI statement. I have not been charged nor convicted of any crime by law enforcement but I lost my career and my reputation is ruined. Thank you for any advice.

Defamation of character and wrongful termination?

Postby elkanah1 » Tue Apr 05, 2011 11:12 pm

I doubt you have a defamation case because it sounds like you were involved in illegal activity. In most states it's only defamation if the information is untrue. I don't think your boss can be held accountable for terminating your employment or sharing the reason with your coworkers. If you have a case at all, it would be against the police department that shared the information. If you don't have something in writing guaranteeing confidentiality, I think you'd have a very difficult time proving your case.
I don't want to seem harsh, but if you are worried about your reputation you shouldn't conspire to commit a crime.

Defamation of character and wrongful termination?

Postby orson19 » Tue Apr 05, 2011 11:16 pm

I would think if you signed any document that specifically stated that your identity and/or actions would remain sealed, and kept private, and then the local pd released information related to your CI actions or involvement in the case, that you have reasonable grounds to sue the city/county police department, and if your state has laws that protect workers from wrongful termination you could also sue your former boss. As for the slander or defamation of character, I think if you can prove the statements false or exaggerated, I think you have a case. Overall I think you can get a pretty good settlement if you try to take them all to court, but you should seek the advice of a licensed legal professional asap.
