Default judgement on Capital one credit card?

Postby aescby » Mon Nov 21, 2011 7:25 am

So I've been dealing with a messed up situation that I am willing to take full responsibility for. I let my sister borrow one of my credit cards for a bad situation she was in. She agreed to pay it off when she got the money so as far as I knew she had been making payments. Well come to find out she never made any payments. How this slipped by for almost a year is a long story but it was not in my knowledge that it wasn't being paid. So I get a lawsuit from Capital one and I freak. So I get several letters from lawyers about bankruptcy and wage garnishment and I don't know what to do so I call one of the people that suggested a payment plan. Great right. No the damn guy doesn't do anything to help the situation instead the law firm gets a default judgement for $1800 and call saying that after 2 months of paying this credit counseling company they haven't recieved any payments. So the guy that called from the law firm says that I can set up a payment plan so I set it up. Then while doing research on the firm, Weltman, weinburg & Reis I find out that you shouldn't give them your bank information when agreeing to a payment plan because they'll freeze your account. Well f*** me. So now I'm just ready to pay these people off cause it's causing nothing but stress but apparently I don't understand the process of dealing with these sorts of law things. So what do I need to do to pay them off? beside have the money. Is there any sort of documentation that I should get? What should I be looking out for when making the settlement?
Please help! I really just want this whole ordial to be over with but have little knowledge of how not to get screwed even more in the process :(

Get a written settlement agreement from WW&R. Pay with money orders so that the agency/law firm does not have our account info. In the long term, recover the money from your sister.

Dump the credit counseling company.

If I understand your post ... You tried using Weltman, Weinburg & Reis to reduce your Crapital One account ... Instead Crapital One sued and got a default judgment against you for non-payment??

If that's the case,, Unless WW&R is talking to C-1 about a settlement,, You need to stop dealing with WW&R and deal with Crapital One,, Crapital One just wants their money and they wont go away till they get it ...

You can call em' and setup a payment plan,, then tell WW&R to fuuk themselves just like they fuuked U ...

Good luck

Contact the free legal services in your area.... Google it. If you have anyone that personally knows a lawyer ask them for advice (friend of a friend... they will probably handle it for free) If all else fails, contact a prepaid legal representative and sign up for their services.... cost like $35 but you get legal representation and letters for free..... they will tell you the details.

Good Luck!
