My Ex girlfriend and I just recently separated but in my attempts to move out of our appartment , which we both signed the lease of , she decides to lock me out and change the locks and when i show up there to try and reason with her ....she goes crazy , calls the police and acts as though i'm stalking her...she tells the police that we broke up over a year ago and that i don't have anything left there...the landlord says theres nothing he can do....even though I'M the one paying the rent...he acknowledges that i am still on the lease , and now it's to the point where she's recieved her eviction notice yet neither her nor the landlord will allow me to get my property...so if any advice you could give me i would GREATLY appreciate Thank you for your time

Hi Matt

Gosh, what a mess.  I don't know where to start because EVERYBODY made major mistakes here.

It all comes down to who is believable and who isn't. Your girlfriend(lets call her Sally) had NO authority to change out the locks without approval from the landlord. HE needs a key to every room in his buildings.   Did she give him a key?  If she didn't, this is against the fire codes of your city.

It appears Sally was more believable than you with the police showing up.  However, all you had to do was get the landlord to tell the police that you have been living there(you had to be seen by someone!), and you are paying the rent.

And if you are paying rent, why is Sally being evicted? What reason is she being evicted? Were you BOTH paying the rent?  She is no longer paying her share?  You realize that since you are still on the lease agreement that the eviction will probably include your name on it as well? Which will NOW go on your credit report?  You had better have a chat with the landlord about this.  This opens up a whole new can of worms.

Make an appointment with the landlord to go into Sally's apartment(which by the lease agreement is STILL yours) and retrieve all your belongings. If you need to have the police there to witness what you are doing, do it. And the landlord MUST have a key to the apartment because it is the law. Not all states will allow this but it doesn't hurt to find out.

You also need to understand that landlords do not get involved in domestic disputes which this is.  Also the police HATE this type of thing because they are very dangerous and their main objective is to PREVENT it from escalating into a shootout.  And lease agreements are CIVIL Law, NOT Criminal law.  Police cannot do anything about them unless their is a criminal law being broken(abuse, drugs, music too loud, etc.)

If you need more info on your situation, you might want to visit the Fair Housing Agency in your city.  Bring a copy of your lease agreement with you, explain the situation and hopefully they can come up with some options for you.
