F1 Visa And Illegal Work

Postby Aethelmaer » Fri Jun 13, 2014 1:46 am

Hi, my situation is complex, i joined the united states under a G1 credit (diplomat) and had documents to work-but when my loved ones quit i slept below like a pupil and extended to work well with exactly the same SS# i was provided despite the fact that i realized I had beenn't designed to. Today at my work we obtained a notice from "Department. of Labor" that was for that supervisor and that I am terrified its anything about me. I'm unsure how to proceed. I'm also involved to some US resident and that I am in the stage that relationship appears like the simplest way to resolve this-but i also have no idea just how to start that being an F1 student.
Additionally, i visited immigration to inquire about my credit which ends on 8/5/08 however they stated that so long as i preserve standing im good... honstly i highly doubt its that simple and although its their work to see people he didnt appear to understand what he was referring to. Is there any such thing like a "grace time" or is what he explained proper?
your aid is truly truly required, thank you.

I am unsure that everyone's on a single site. You had been referring to oneself like a G1 credit owner, however, you are talking about an F1 grace period. Study this:

Estimating Grace Period
F 1 pupils might stay the U.S. for 60-days following a conclusion of the ultimate diploma need (often the "total reports no later than" day on Type I20). People in F 1 standing could also stay in the U.S. for 60-days following a termination time of article-conclusion recommended functional instruction work agreement. The 60-time grace period applies in its whole even when it's been utilized on a prior event. Quite simply, if your pupilis OPT doesn't start until 60-days once they finish their reports, that student continues to be permitted have a 60-day grace period after conclusion of OPT.Extremely significantly, no student might make an application for an F 1 standing associated advantage throughout the 60-day grace period. Throughout the 60-day grace time:you might not make an application for entrance towards the U.S. in F 1 statusYou might not make an application for a course extension. You might not function or study.
These same requirements affect any intervals in between this program end-date on Type I20 and also the beginning of legitimate elective functional instruction work agreement except that pupils might make an application for entrance towards the U.S. if complying using the paperwork needs defined within the journey overseas section.
If you don't create a low-careless software to alter standing to begin with day prior to the end-of the 60-day grace time, you have to abandon the U.S. prior to the end-of the grace period.

F1 Visa And Illegal Employment

May be the company in some trouble even when he does not understand?

He might be. It is the employeris obligation to understand - you are predicted, being an employer, to maintain particular types updated, such as the I 9 for work eligibility.
Do not stress just however, okay? Companies get garbage in the Division of Work constantly, often reminders to show particular rules or informing of improvements to others.
If it were about you, the cover might much more likely be in the USCIS.

thank you for your response. is the employer in trouble even if he doesn't know?

how ridiculous is it that I could work 'off the books' or sell drugs and not get punished?
