Hello,

Our daughter's caretaker's husband has left the country to visit his family in Vietnam.  He left last year and the last they heard from him was 12/31/07.  The caretaker discovered he canceled all their life insurance policies and health insurance policies.  He also owned a gas station and sold it.  They have a 12 year old daugther. What recourse does she have at this time?  Can she file for divorce even though he is no longer in the U.S. and she has no idea where he is in Vietnam. He doesn't answer any of his cellphones.  Any legal advice I could give her?

I AM NOT A LAWYER or ATTORNEY. I am someone who has experience with family law issues, and am sharing my OPINION only. For the exact law as it pertains to your specific case contact a Professional Attorney in your area/county/country.

I recommend that you seek out a Professional Attorney. However, be aware that since it has been over a years since you last heard from him, and he has fled the country the chances of finding him are pretty slim. I recommend that she keep a log of time/date/phone numbers when and if she is able to contact him. Try contacting all know relatives, etc.

She will also need to contact a Professional Attorney ASAP because of the complexity of the issue: Most Attorneys offer 1/2 free consultation to discuss the case and payment arrangements.
