Family law no show ruling. What recourse do I have?

Postby golding » Thu May 03, 2012 12:49 pm

Hello,
I have a family law case in CA. The other party filled a OSC for CS issues. My response was filed and court was set for 5/1/12 at 9:30am. (noted on the OSC served). When I went to court at 9:30am I was informed the case had already been ruled upon because I did not show up at 830am. I pleaded with the judge and explained the time was set for 9:30am. The judge said it did not matter i should have been there at 8:30 and there is nothing that can be done now. What is, if any, my recourse to undo what has now been done?

See a lawyer. You were under no obligation to be there at any other time then the 9:30 appointment.

It sounds like you have been railroaded. The other side evidently had a lawyer, and he connived with the DA and the Judge, and had the ruling go in his clients favor.

If it were legal for them to do that, it would be legal for them to hold it a day early without notifying you, or even a month earlier.

File something against the court stating that the ruling was unfair and that you disagree with the judge. You dont have to be there at 8:30. You have to be there at the time designated. Make a stink about it. Ask a clerk what to do
