Georgia workers compensation?

Postby adare » Thu Feb 23, 2012 7:49 am

My husband was on the job driving a mixer truck. A guy pulled out in front of him, he swerved to miss him but he ended up hitting him. He broke his neck and messed up his rotary cuff which required surgery and both required physical therapy. Workers comp has paid all medical bills but hasnt paid us for 2 trips that we had to take for gas mileage to the doctor. We have settled the personal injury claim and workers comp put a lein on it wanting us to pay back all the 34,000$ medical bills. Can they do this?

You should have a work comp lawyer. Ask him/her. If you dont have one you need one. Find one that only takes work comp cases. By state they can only take a certain percent of the work comp settlement. Just be clear what you sign when you sign the lawyer agreement.

The lawyer before you settle your work comp case will make sure all of your bills, mileage etc are processed before you settle. Also you need a work comp lawyer because your husband will need continued medical care so that needs to be included in the work comp settlement.
