Hernia Repair Mesh Infection

I had a hernia repair last September 27th that was repaired earlier in 2/22004 by another surgeon but did not hold up. However, I am concerned about this more recent repair after surgery i went back to doctor for staple removal and he told me he was finished with me. i was surprised as i thought he would need to monitor the huge incision(I have a mesh across half of my abdomen). I returned to work after 6 weeks and although a little slow I seemed okay expect i had some drainage in a spot and looked like a hole in another. I called his nurse she told me to monitor it for infection and if it got stinky and beat red go to a clinic. The spot eventually healed but i still had this hole that was not and eventually it started to hurt. i called the Doctors office and they told me I needed to go to emergency room, but I insisted I needed an appointment to see the Doctor. I went there on or about February 15th but the office gave me a hard time about re filling out paperwork they already had previously so I ended up leaving and not being treated. I had puss coming out of this hole and needed to keep it covered all the time. When going for a Physical on March 30th that Doctor thought it might be infected and sent me to the ER. There they prescribed Antibiotics and set a follow up appointment for 3 weeks. They were never clear if in fact i had an infection. The Antibiotics cleared it up some but it was still leaking when I showed up for a follow up(all this was in Memphis) in 4 weeks. That Doctor told me I should see original Surgeon because he knew the mesh. he also said pray a lot as you may have to have it removed. I returned to my Surgeon in Atlanta area on May 9th. he said it looks like it's been infected and may need to end up coming out. But he cleaned mesh out of the wound and prescribed Antibiotics, which I'm now taking and will go for follow up next week. i don't want to lose work time if this needs to be done. Do I possibly have a case because of poor post surgery follow up? Also do I have a case where I should of been able to see the Surgeon in February rather then be hassled by his office?

You can't sue the doctor for being discourteous jerk. You have to live with that.

However, you are right about his failure to follow up on his work and to see to it that you were healed. Apparently he didn't care what happened to you. All your distress and infections are owing to his poor attitude toward his patient; to his excessive use of mesh; and to his failure to treat your infection. You can and should sue him for this.

Now, lawsuits about the use of mesh have reached a high point, enough so that 'class actions' are being worked all over the country. Probably the best thing for you to do is to go to Google and search for mesh infection lawsuits; hernia repairs and mesh infection lawsuits. I am sure you will find a lawyer in Atlanta who has a file full of these cases. Google should list for you open cases and you can call one of the lawyers. Memphis probably is out of it because by then you knew you had a lawsuit pending and they do not seem to have done much wrong. Although they were no help.  Do this search mesh lawsuits or mesh class action lawsuits. This will save you the trouble of looking for a lawyer.

Any lawyer should be happy to talk to you.
