Hostile Work Enviorment

Leo Hi I am a director of Food & Beverage at a golf club in California, the area where this club is in a small community, I have little chance of Hiring team members outside the community so a lot of my team members know each other. My situation is that I expect my team to follow directions, and when they don't I have reprimanded. there is a lot of gossip the runs ramped and I heard that some of my ex-employees had file a class action law suit, I passed it off till the other day I received a notice from CA EDD of a team member who was trying to file for unemployment, mind you he walked off the job six months ago and just filed, his reason Hostile work reason with a class action law suit pending. Neither I nor the Central office have received any subpoena, on top of that I had a team member in my office along with another manager during the conversation this employee accused me of a hostile work environment, simply because I had stated that if he continued to make decisions with out management approval I would give him a write up, this is the third verbal I have had with him and he has only been with the company three months he just passed his 90 day mark. I very concern that these team members are ganging up and I at a loss as to what to do it's almost a reverse, I feel I can not do my job because I have to watch every step. As a manager I'm not always perfect during stressful times I have yelled at a team member for not following the instructions but that far and few. I as a manager always have a second manager in my office when I speak to any team member or reprimand. Can an employee file a Harassment or hostile work environment just because I have reprimanded a team member, I have never discriminated, call anyone names or touched anyone what can I do to protect myself.

I  HAVE  LISTED  BELOW  THE  DEFINITION  OF  DESTRUCTIVE

WORK  ENVIRONMENTS.

Bases  on  your  brief,

-you don't  fall  in any  of  these  categories.

As  a  manager, you  can  pull  up/ reprimand  any  subordinate  for   wrong  doing.

MY  SUGGESTION,

-contact  your club's  legal  counsel.

-put  the  scene /  facts  in  front  of  him.

-it must  be  defended,  but  in  legal  terms.

I  DON'T   THINK   YOU  SHOULD  WORRY  TOO  

MUCH  ON   THIS  MATTER.

1.Hostile work conditions

Hostile Working Conditions include behaviors that are INAPPROPRIATE and UNACCEPTABLE in the workplace. Inappropriate and Unacceptable Behavior is bad behavior that goes beyond incivility, yet does not meet the legal definition of Hostile Work Environment(HWE).

Examples of Inappropriate and Unacceptable Behavior that create Hostile Working Conditions:

·   Demeaning, harassing, belittling others; name-calling

·   Emotional tirades, tantrums, and displays of anger

·   Humiliating, intimidating, threatening others

·   Gossiping, spreading rumors about and damaging a co-worker’s reputation

·   Refusing to follow authority without very good reasons

·   Being argumentative with no good reason except for trying to start a fight

·   Swearing or using obscene language in very public places without regard to the reactions of others

2. Hostile  working  environment Hostile  Working  Environment   Defined-

It is —   Is offensive behavior that is objectively intimidating, threatening, abusive, humiliating, etc. —   Is behavior that is either very severe or is repeated frequently and / or is pervasive —   significantly alters the working conditions and / or  unreasonably interferes with work performance; affects a term or condition of employment and / or causes harm

—   Was directed at the person’s gender, race, color, age, religion, national origin, or disability.
