How can I get a debtor to stop calling?

Postby sylvester37 » Wed Mar 28, 2012 12:29 pm

If you have hired an attorney then you need for them to contact the hopstial as well.
You cant get too mad at the collector cause they are just person in a cubicle making 10 bucks an hour to call and try to collect on a long list of debts.
Alot of times they do not imput information on your file and then the next person calls with out knowing.
hopefully it is just that.
Try to contact the hopsital administration or the manager that oversees the Accounts payable department. Maybe they can help.
you dont want to totally eliminate their calls due to any change that may take place or a question they may have.

hope it all works out, my prayers are with you!

If you are not the one who is responsible for the repayment of the debt then yes they must stop, give them the correct phone number for your son and they will contact him. However if you are the responsible party for the debt they have every right to call no matter what you say. I would have your attorney contact them, it will be done in form of a letter (legal purposes), and he will explain the situation and they need to contact him and not you. That is what he is being paid for, until this happens you can either not answer the call or block it what ever your option or you can change your number and keep it unlisted. Hope it all works out for you.

According to the Fair Debt Collection Practices Act, you have the right as a debtor to request a collector to cease and desist all telephone calls made to you that you deem to be inconvenient.

You can verbally request them to stop calling, but a certified letter works great. If they do not comply, advise your attorney to proceed with a lawsuit for violation of your rights.

Write them a letter like this:

"According to my rights under the FCRA, I dispute your claim and demand that you cease all communication with me regarding this debt in any way, shape or form."

That's it. If they contact you again (besides exercising their right to notify you of a lawsuit) they are breaking the law.
