How do I know if I am being sued?

Postby siwili » Fri Apr 01, 2011 10:46 pm

I received a certified letter from a law firm who had been retained by their client for what they named: Loss Type: Personal Injury: General Negligence. No where in the letter does it give a case number, etc. Does this letter mean I am being sued or just a precursor to the filing of a possible lawsuit? They are requesting all my personal insurance information? Am I obligated to respond and provide this information? The letter lists a receipt number and was sent certified mail but other than that it does not say I am being sued and reads as if they are trying to assist me by directly communicating with my insurance company so I can avoid prejudice or inconvenience. It says lack of notification to my insurance company may result in prejudice? What does this mean?

You are not being sued and likely won't be if you are insured. If you do not provide the information, then you can be taken to court and held personally accountable and liable for the damages that your insurance company would otherwise pay.

They aren't trying to assist you as much as they are trying to assist their client by dealing with your insurance directly.

Did you inform your insurance company that you had an accident? Did you tell them of any tickets you may have gotten as a result? Did you give them details as to any accident that you may have caused, even one where there appeared to be no damage?

Give them the information as requested and inform your insurance company. They will take it from there.

This guy is out for a quick buck. He was our former lawn guy who our dog nipped in the leg and now he is trying to sue. The bite did not even break the skin. Our insurance policy does not cover dog bites so we know that the insurance company is a dead end and don;t want our rates to go up if this

certified letter doesn't count for anything. if you're getting sued, a person called a 'process server' will show up at your door (or at your work or whatever) and hand you the papers and tell you that you're getting sued.

once that happens, tho, any further information will be sent by certified mail.

and you should either completely ignore that letter, or send it back to them with some poop in the envelope, or call your insurance company and ask them about it. but absolutely you should not give them any information or anything else.

Call the office number that must be printed somewhere on the letter. If they are unable to tell you the name of the person who filed the complaint, then nothing official has been done yet. Once it's filed, you have every right to know who it is.

This is likely a SCAM.

Do NOT provide your information.

If they get all of your information they will probably file a false claim against you (and claim that they got the information at the time of the "incident").
