I live in Missouri, I'm in the Army (I ship to basic in Sept). My gf and I and our 3 kids are being evicted and we need to be out by the end of the month. Though there has been no court order as of yet, we are trying to comply to the Landlords request. There is no damage to the place, and no drugs or abuse going on.
We paid rent through to the end of April but haven't been able to cover May as we were laid off and unable to find work. My father mailed a rent check to the Landlord, which he in turn refused and sent back.
We had painted in the house, we got permission from the Landlord. We painted the living room, hallway, bathroom, and 1 bedroom (various colors). He has after notice of eviction demanded that we paint the trim and doors in the kitchen and the other rooms so that everything is uniform, and if he doesn't he will withhold deposit. The trim and doors that we painted were originally a cream color, and the rest of the places are all wood. It wasn't uniform when we moved in.
He also called us on my son's birthday around 2pm and told me to have the place ready for someone to come over and walk around inside to view it. This was 2.5 weeks before we were even supposed to be gone. When this happened we argued on the phone and hung up, he proceeded to call me 15 times the rest of the day into the evening.
What kind of things can he hold my deposit for? Can he really make me pay for covering a paint job that he did before I moved in? Not having weeds pulled or lawn mowed perfectly by the time we leave?
Can he really do this to all of us even though he refused rent when it was sent to him?
Is he harassing us? Discriminating? I don't know what to do...

If he is evicting you, he can refuse to accept rent payments, since that would allow you to stay in the apartment. So that part is perfectly legal, and may even be required as part of the eviction process.

And, even if you asked to paint, the general requirement is that you have to paint it back to neutral before you leave. So I'd either do that or be prepared to have the cost of repainting withheld from your deposit.
