I got a letter in the mail over a year ago for when i workd at Starbucks to sue the company for meal and rest breaks not given or interrupted without paying an extra hour. The lawyer said this case will get settled, probably won't go to trial. Anyway, ii was chosen out 500 people for my case to be deposed, as well as 24 other individuals.Why was my case chosen? i asked one of the attorneys and even HE didn't know.
It was almost certainly a random drawing of a certain percentage of names. A "representative sample" of the entire class. The size of the sample would be agreed upon by both sides of the case, depending on the total number of persons in the class.
So 25 people is 5% of the class, again almost certainly done by random drawing or some contrived formula.. like "eeny meeny miney mo", or simply "every 5th name".
