My 16 year old son, broke his fibula during gym class at school.  After they had him sit for 2 hours in the office, they called to see if he could be sent home.  During the 2 hour wait, neither the sports medicine gym teacher or school nurse bothered to even apply ice to the injury.  Is the school in any way liable for medical expenses?

Michelle,

I am sorry to hear about your son’s injury and the ordeal he had to undergo as he waited for medical treatment. I hope that he has a full and fast recovery. You want to know if the school is liable for your son’s medical expenses. Depending on the insurance held by the school, their medical insurance may cover your son’s injury since it occurred on school grounds. I recommend that you send a letter to the school principal stating that your son suffered an injury at school and asking the school to contact their insurer so the insurance coverage can cover your medical expenses.

The response to your son’s injury by the gym teacher and the nurse sounds inadequate. You may want to write a letter to the principal or the school board asking them to investigate the matter and to draft new policies and procedures as necessary.
