Is this dental malpratice?

I got an emergincy root canal done about a month ago and a week after it was finished i started feeling sick again so i went back. This person i went to wasnt my realy dentist.

Anyhow i was told that the root canal had failed and that i had developed a cyst and would need surgery to remove it and that he couldnt do it.

So i returned to my normal dentist and he can do the surgery but my question is:

since the root canal 'failed' do i have to pay for it?
Can i get compensation for the surgery and a return on the money i have paid for the root canal?
Ive also had to miss heaps of school, its a front tooth and so i havnt been able to bite anything and can only have soft food. Ive had to buy alot of medication and im in a very big amount of pain.

So is this medical malpractice,can i get compensation?

A 'failed' root canal is not necessarily the dentists fault - it sounds like you may have already had an infection since it was done as an emergency. Expecting there to be no chance of the infection continuing is similar to getting an appendix removed and expecting no infection.
We all like to think that a professional can guarantee results, but in a medical setting... If you have suspicions that it was botched, then follow through on that, by all means.

I suggest using sensodyne - and a blender. If you do a typical PB and banana smoothie and add a cup or so of cheerios, it's a bit more filling. And if you have been taking ibuprofen, see if Aleve works - you don't have to eat to take that.

As far as it being so sudden, well.. a lot of people think there are no problems if there is no pain - never mind that diabetes, high blood pressure, etc, don't hurt until things have gone on for a long time. Tooth pain usually doesn't show up till severe damage has happened. And all root canal treatment carries a risk of infection.

no its not malpractice, its negligance on ur part .the emergency root canals are done only when there is pain and infection. it takes a while for teeth to get to that condition. you should have taken care of the tooth before it got that bad.

Sometimes there is bacteria that the naked eye can not see that is in the root canal that causes problems. Not due to an infection. Look up in a search "dangers of having root canals" on google. Root canals are very dangerous. There are several books on the subject of root canals stating this.
