Judgement

Postby Donnally » Sat Jun 28, 2014 11:01 am

My wife who became permanently disabled about 3 years ago has recently been sued by a creditor and has had a judgement entered against her for approximately $6000 for a credit card debt we have not been financially able to repay. She collects social security disability, we do own 3 vehicles one that is 11 years  old that my young adult son uses to go to school with and has no real value, but two that are 4 years old and worth abouth ten thousand dollars combined and fully paid for. Our house is totally underwater with a primary and second mortgage. My question is, what do we do now? Do i remove her name from our joint checking account and from the joint registration & titles of our vehicles to protect them, or is that a waste of time? We have no savings and were told we are not eligable for chapter 7 bankruptcy due to the vehicles value and also are not eligable for a chapter 13 due to the fact that we do not have enough income to pay back our debts to the court. I have a job but my pay is rather low and we have a disabled adult child living with us and i am concerned that a drastic action such as the freezing of our bank account or seizure of a vehicle could cause a great hardship on our family. Please advise what i can do to possibly protect our limited assets. Thanks.

ANSWER: Could you tell me what state you live in?  Thank you.

Judgement

You are virtually judgment proof but just in case, if i were you, I would seek the advice of an attorney.  I have researched this and do not want to give you bad advice.  The web site is:  http://www.floridalegal.org/.  Be sure to ask them about the bankruptcy to verify accuracy.

I hope this all works out for you and good luck.
