Malpractice. Do I have a case.?

Postby eilis » Tue Mar 27, 2012 11:02 pm

I'm an eighteen year old female. one year ago during a soccer game my right knee cap dislocated. I saw an orthopedic surgeon, went through PT and had my knee scoped because there was damage under my knee cap which caused pain. MRIs showed my knee cap was naturally higher than it should be. After the scope, it was supposed to have gotten better, but instead it got worse and dislocated several more times on several occasions. The only other option was a major surgery that would move my knee cap where it was supposed to be (tibial tuberosity and lateral release). But this doctor said his patients didn't like it and it felt "unnatural" after it all.
I'm very active. I play soccer on the swim team, the fastest girl in school. And my knee holding me back was just unacceptable to me.
So I saw another surgeon, one who does surgery on the Dallas cowboys, stars; very prestigious. I told him about my problems, got another MRI and he said the surgery is best and convinced me if i dont get it ill get arthritis & his patients never complained of it feeling "unnatural" and that I would be able to get back to all of the things I used to do when it's over. So I naively agreed.
I told him all of my medication (birth control) and I read up on the surgery and that it was very common to be prescribed blood thinners or given stocking to prevent blood clots.
The first week, I ended up getting two blood clots in my calf. The most painful thing ever. So I had to see another doctor and was put on blood thinners (rat poison)for 3 months. I still have hardening around one of the veins in my leg but have just been given the A OK to get off my blood thinners. I told All other medical professionals I ran into along the way and they would all look at me in awe and called it negligence. It's been almost 4 months and I have full rom, my knee cap doesn't dislocate, but if any word describes how it feels, it's unnatural.
I can't run. I can't jog. I can't do squats or anything bc it will pop or grind

Malpractice. Do I have a case.?

So all the doctors you have talked to said the doctor was negligent, and you are asking the yo-yo's on Yahoo Answers to decide if you have a case?

I do not think you are a very trustworthy reporter. I decline to offer you an opinion.

I don't see anything here for a malpractice claim. You would have to show that the second surgeon was negligent in his care or acted with malicious intent. I don't see any evidence of that here.

Just because you read on the internet that doctors commonly give blood thinners doesn't mean that the doctor was negligent in not giving you one. There could have been valid reasons for why they didn't want to put you on blood thinning medications. "All the other medical professionals" you "ran into" along the way didn't have access to your medical records and weren't treating you, so it doesn't really matter what they say anyway.

Your burden of proof in a malpractice suit is very high and you don't really have anything to go on here.

Guess you should have listened to your first doctor, eh kiddo?
