Medical malpractice claim?

Postby bocley » Thu Jun 21, 2012 4:02 am

I need advice quick. unfortunatley on may 14 my two month old daughter passed away. at the time we did not know why......but we do now. anyway, we called the ambulance and we went to the hospital where she was pronounced dead. the physician on duty did a so called examination on her and this is what she wrote in her notes...... she said there was bruising on my babys face, hemrogeing in her eyes and brain, blood behind her eardrums and blood behind her eyes and abraisons on her buttocks not typical with everyday diaper rash. she pretty much in her own words said that we beat our daughter to death because at the bottom of her notes she said that she was concerend about my other daughters saftey.....shes two years and the light of my life. Here is where it makes me pissed. Cps took our daughter that day. Keep in mind that the reason they took her is because of what the physician at the er had wrote in her affadaviat. The next day the medical examiner.......the person that makes on average 90 thousand dollars a year to do this sort of thing, did a full autopsy of my daughter and said he has no idea what the physician saw but he saw nothing of the sort. no bruising no abrasions no blood in her stool her ears or her eyes. he said everything looked normal. of course they had to cut her every way in the world to get to that point but all because of what the er physician had stated. now we still havent gotten our daughter back and my daughter was buried without eyes, a brain, a spinal cord and a lung.
my questions is.......is there any kind of law suit that i could file against the doctor and or hospital. malpractice or how about deffamation of character? Please give me some kind of insight on what you believe and or think. Thank you and GOD bless.
