Motion For Lack

Postby Kennan » Fri Jun 13, 2014 8:27 pm

I reside in Iowa, submitted a Section 7, within the Section 7, my home (residence) was surrendered for the Trustee. The Section 7 was released. The Trustee was not able to promote the home. The home subsequently went into foreclosure and offered at sheriffs sales. Today the financial institution has submitted a "Movement for Deficit". Do I owe the cash? What must I do?
Motion For Deficiency

The process ought to be this:
1. You find to submit the house inside your Section 7 bankruptcy;
2. The trustee investigates to determine when there is collateral in your home;
3. When the trustee decides that there's no collateral, the trustee documents a Notice of Abandonment;
4. Using the trustee having forgotten any state towards the home, the lending company profits with foreclosure. Despite a deficit, your responsibility could be discharged.
I don't understand what is occurring for you personally - just what ought to be occurring - and that I can't describe a movement for deficit underneath the details you've provided. Speak to your bankruptcy lawyer.

After closer reading of the materials...it is my former condo association suing for maintenance fees plus interest.

Motion For Deficiency

I was hoping to avoid having to hire an attorney.

Should I contact the bank or just go to the hearing with my discharge papers?
