My Boyfriend And I Have Been Talking Marriage, He Pays Child Support.. Will I Be Expected To Pay If He Doesn't.

We live in Michigan. How do we get married with out the courts yanking all of my taxes.. He was paying child support before i came into the picture, Why should i have to pay after we get married. I have 3 children from my previous marriage and i don't expect him to take care of my 3 children.. Does anyone have any answers for me.. I love this man with all my heart. I dont want the Child support laws to stop us from being married. But If need be, to save my butt, we wont get married.

The others are right - to keep the IRS from taking your return you have to file married filing separately on your taxes. No big deal. His child support shouldn't become a huge issue if he's basically keeping up. If he gets to far behind they could start trying to take his drivers license & all this other stuff but it doesn't sound like you're going to let that happen. Don't sweat it. You can get married without having to wrooy about that - and, you can file married filing individually to protect your tax refund.   Schelli 33 months ago

i don't hold money higher than him, I just didnt know how to go about it to where they don't get us both.. He also didn't want to get married if they were going to take all of our taxes.. It's a mutual thing.. Just wasn't sure on what to do!! I've always been their for him. I've helped pay his child support when he was out of work for 8 months,(layed off) and Been to court with him when they wanted more money. SO I'm deffiantly there for him no matter what!! And i've helped him buy stuff for his children when they needed it, SO im totally in support.. not one of those money hungry women.. We really very very so much wanted to get married but kept hearing all the horror stories.. And michigan's child support laws are rediculous and im sayin that from a womans stand point.. My ex husband and i have 3 kids together and i dont get child support.. We have joint legal custody.. The courts made it exzempt.. And im okay with that. JUst want to move on with MY Life and the person i adore so much, Thanks for you answer though..   Michigan1973 33 months ago

He is responsible for the child support. However, if he gets behind, and you file your taxes jointly, they will take the refund that actually is due to both of you.So, get married, but keep your finances separate. When it comes to filing, you need to file married, filing single. As for you placing money higher than him, and his children, well, I suggest you not marry. Money is the biggest cause of divorce.   TurboB 33 months ago

He is responsible for child support until the children reach 18 years old. If he defaults, his ex can take him to court and garnishee his wages or put him in jail if he can't or won't pay. As for your responsibility if he defaults, I don't think you are liable but I foresee that you would pay to keep him out of jail. Consult a lawyer.Of course, you don't expect him to pay for your children. That's because your ex is responsible for them, just as your current love is responsible for his children. Everyone has a right to start over and have a happy life, but you can't shed your past responsibilities to do so.   MaryAnn 33 months ago
