My Former Employer Has Not Paid My Back Wages And Now He Is Filing Bankruptcy. What Can I Do To Get My Money Now?

He sent me a letter stating that he would begin paying me last year but I haven't seen a dime. I also didn't sign anything to this agreement. When I would ask about payment he said he didn't have the money. I didn't want to take him to court, but I probably should have since he's now filing bankruptcy. He's asking to discharge his debts. Is there any way I will ever get paid my $2,000?

He owes you(and others) the money and you need to attach yourself to his filing as well as file with your state's labor law bureau. Try to be the priority payee since yours is a matter of state law.But if he really doesn't have the two grand, he really doesn't have it and you really won't get it. danielpauldavis 27 months ago

Make sure you file a Proof of Claim with the bankruptcy court. You may be able to file one online if you have the BK case number. The Proof of Claim is typically used by creditors to indicate the amount of debt owed by the debtor. Your claim will give you the right to receive payment on the debt owed.
