She is a counselor at the YMCA watching teenagers in their after school program. It is a part time position, she gets no benefits or anything of that nature. The children are 11-12 years old. Anyways, she was sitting on a chair and one of the kids came behind her and basically kicked it out from under her and basically hurt her lower back/tailbone from the impact of falling. Her and her supervisor filled out what I would assume amounts to an incident report, and they told her to go to the local doctors the next day even though she asked for an ambulance, which the YMCA said they could/would not cover. What I'm curious about is what should we do if the doctor determines she has a serious or substantial injury? Was it wrong/negligent for them to not allow for her to be taken to the hospital? Should we contact a personal injury lawyer if she will have any type of medical bills? We are in North Carolina and I'm not too sure about their labor laws as far as workers comp (esp. for part time workers), so I'm just curious if anyone has any general advice for this situation.
if she is paid, part time or not, she qualifies for worker's comp. What she should have done is gone straight to the emergency room, should go there now in fact. A work related injury is covered by the state.
