My insurance policy has paid out a large third party claim almost a year ago without telling me. Not ok?

Postby salvadore94 » Fri Mar 02, 2012 11:36 am

I have found out today, when trying to renew my car insurance, that the price has been increased by 100%. This is because a third party claim for a large amount had been paid out May last year for personal injury. The accident happened in a car park, where i reversed out of a bay and collided with the third party. There was very minor damage (scratched paint) to the car but they went on to continue a personal injury claim without my knowledge. My insurance company failed to inform me. Is this legal/ acceptable? Please can someone let me know...

Your insurer does have to tell you about the payout but generally only if you ask. They usually won't do anything proactive about notifying you.

Your policy also probably has a clause in it that says something to the effect of "we will settle claims against you as we see fit".

Generally speaking the only time you have any say in how an insurer settles a claim against you that is below your policy limits are in some professional liability policies (doctor, lawyer, etc...) in a malpractice claim as it can have indirect effects on the insured's professional reputation.

To save money automobile insurance is a quite simple way to save a lot of money. You can get a fast quote at websites they always give you competing prices.

I know people who have used and recommend LowRateToday.com

Your insurance company does not have to tell you about the pay out and you would have no say any how about if they pay or not pay. Fair, maybe not, but that is the way it is.
