Nail salon being sued?

Postby hyun-su » Thu Jul 26, 2012 2:36 am

I have a client to comes to see me several times already. He only comes to the nail salon to get his pedicure done, and goes elsewhere to get his nails done. This client has thick callous, and on one occasion, i scrape his foot too hard and cause him to bleed. I applied and antiseptic solution and it immediately stop the bleeding and apologies to him for the injury. I continue his pedicure, finish with a massage, and he paid and left. Two weeks later, he came back and showed me the injury. He made such a big scene while I was in the middle of working on another client, took some pictures of the salon and myself and left. Two hours later, he came back with a small claims letter delivered asking for $1000. In the letter, he said that I made a gouche the size of a nail to his foot. I don't know what he meant by a gouche, even looked up the word and not in the dictionary. I'm assuming something like a hole, cause that's what me told me. Honestly to say, I didn't not know how this came about. He showed me a picture of his foot that was really horrifying. During the pedicure, it was only a minor scratch, but it did bleed. It seems fine when he left the salon, I even massage this whole foot. Now I'm facing court time soon and I don't know what to do or say. What's the chance of me winning this case? I work only part time since I have two small children at home, only goes to work whenever my husband can take care of our children. This man only comes to see me and is my regular client, I didn't know he was that evil. He comes every 2-3 months, have thick callus, and knows I work every hard to satisfied him. I called him once to come up a solution and offer him $500, but he refused. I really don't want to go to court because I already know I will not get a fair trial. Please give me advice.

Get a lawyer.

You acknowledge that you caused the injury, so you are liable. If he won't settle for a smaller amount and you can't afford to pay the $1000, then you'll need to get some proper legal representation.
