I had surgery on 2-17-10 to have a fibroid and 2 polyps removed from my uterus. The surgery went well but 2 days after I started to have excessive bleeding, swelling and quite a bit of pain. Im going to try to make this as short as possible but its a little extensive. My doctor sent me to the ER after returning my 9am phone call after hours. The ER was really busy but did an ultrasound and consulted with the doctor on call from my OB's office. They said it all sounded normal after my surgery. I returned to my doctor the next day and she said I was having a reaction to the sterile water they used to flush my uterus during surgery and it will just go away on its own. It did not get better and sometimes the pain was so bad that I couldn't even stand up. Bleeding was very very heavy so I went back to the doctors office and saw a doctor that had been with the practice much longer and thought would be able to help me more. He said I had an infection and put me on meds including 3 birth control pills a day to get bleeding under control. The bleeding went down to a light amount. I went back for a follow up 1 week later and he said to go back to normal once a day birth control and he would see me in 3 months. Well the bleeding and pain started full force again on the weekend and the office suggested I go to ER again! I choose to wait til monday and went to see the doctor again. He said it was my hormones being out of whack and it was a matter of getting them under control. He switched my birth control pill to a stronger one and said we would just have to see how it went to come back in a week. The next day I felt as if I were in labor and passed a large piece of tissue (this is 4 weeks after surgery). I called the doctor and he said it was normal and blew me off again. I tried to explain I was still in alot of pain so he called in an antibiotic to my pharmacy. Ugghhh!! It took me a while but I got smart and found a new doctor:) After having 2 more ultrasounds done we have found out that the fibroid was never removed and there is also one polyp remaining. It has been 8 weeks since the surgery and I am still lightly bleeding although the pain has subsided. This is a rather large fibroid and the doctor said it will be more than just a little procedure to remove it. It wasnt something that could have been missed during the original surgery and I was told it was removed and non cancerous according to the biopsy.
I don't even know if I have a case but I do know that I have major medical bills from this first surgery and don't feel like I should be responsible for them. I will now have the additional expenses of another surgery to complete what the first one should have. I would love any legal advice as to whether I should pursue hiring a lawyer. I would never sue someone for anything frivilous and am not looking for a lawsuit around every corner but I am really frustrated with this whole situation. I have had over 8 weeks taken away from my life when it should have been a one day recovery. Thanks for any info!!

First, if you want legal advice, talk to a lawyer, not some anonymous person posting who has no knowledge in the law, and just pulling his advice out of his you-know-what.

It sounds like you may have a case. Don't be afraid to talk to a lawyer to find out for sure. Many offer free initial consultation to 1) determine if you have a chance, and 2) let you get to know if they are someone that you feel comfortable hiring for your case.
