My spouse began seeing a brand new physician in the starting with this year. She's had some reoccurring troubles and her previous doctor(who was not a skilled), proposed we see somebody who worked a lot more particularly with her sort of dilemma. In Febuary, my spouse visited this doctor, and decided to have him run a test. She only gave authorization to run one particular. We later got a bill for 3 tests! Also, on another go to, she named in 2 nights just before informing them that she has her period and questioned climate or not the physician may possibly appropriately detect or function tests. She was told it would not be an concern. Well positive enough, it totally was. A physician utilized much less than 5 minutes with her, told her that he cannot treat her, and left. She also waited two hours to see him as he was working behind! We were charged for this go to and two tests that have been unauthorized, and here's the kicker... he in no way really spoke of those tests or gave us any effects! She also discovered him in a later dateCONTINUED in Dialogue!

I consider you might speak to his giving assessments with out authorization and that she requested not to get as malpractice.  If you happen to be out only $300+, it'll most likely cost you a lot more to fight it in court subsequently to cover the bill.  I do not know if it'd do worthwhile or not but you might write a letter of complaint to the Medical Board within your state.  The goal of state panels are to safeguard the public and I'd consider this falls within the group of the public requiring protected.  I'd spell it out in wonderful depth in your letter of complaint and ask due to their help.  Normally Planks don't get involved with financial conflicts but I believe the issue of the physician giving verify you especially asked him not to is just a fantastic situation of concern.  I think his showing you he could not deal with you right after initially contacting his workplace to ask whether in the future or reschedule is certainly an concern.  You may possibly decide to obtain a copy of one's health-related records and if not the Medical Board can easily do that.  You've truly right underneath the HIPAA regulations to appear at your medical records.  Heck, I'd be tempted to send him a bill for your 2 hours and gasoline for wasting your personal time but he'd in no way devote it.

Need Some Legal Advice About Medical Malpractice. See Details!

I am no lawyer but these are my thoughts I think you can call his administering tests without permission and for which she asked not to be given as malpractice.  If you are out a mere $300+, it will probably cost you more to fight it in court then to pay the bill.  I don't know if it would do any good or not but you could write a letter of complaint to the Medical Board in your state.  The purpose of state boards are to protect the public and I would think this falls in the category of the public needing protected.  I would spell it out in great detail in your letter of complaint and ask for their assistance.  Typically Boards do not get involved in financial disputes but I think that the issue of a doctor administering test you specifically asked him not to is a great issue of concern.  I think his telling you he could not treat you after first calling his office to ask whether to come or reschedule is an issue.  You may wish to request a copy of your medical records and if not the Medical Board can certainly do that.  You have ever right under the HIPAA laws to examine your medical records.  Heck, I would be tempted to send him a bill for your 2 hours and gas for wasting your time but he would never pay it. iamhobbit 68 months ago Please sign in to give a compliment. Need Some Legal Advice About Medical Malpractice. See Details!

Postby torran » Tue Feb 11, 2014 8:27 am

and he didn't mention it. This doctor was not doing his job, and he knows it too, because we recently got a letter stating that he is no longer able to provide my wife with medical care, due to recent events which he feels "damaged" their relationship. My wife has no clue what events these were.So basically, since I am insured, I called my Insurance company. They have no department that handles disputes on claims. They documented these events, but are unable to do anything about the charges! I have a $2600 deductable, so I am paying this doctor $347 out of my pocket for services we did not authorize, and for a visit in which he did nothing but tell my wife he could not treat her(after we asked this specifically!!!)We took this up with the doctor and he is refusing to drop these charges. Although my wife does not have any injuries due to this doctor, I would still consider this malpractice. He cannot run expensive tests at our expense without our authorization, and not even give us the results. Especially when my wife told him specifically why she did not want the tests run, one of which she had run by another doctor not 3 months previous to that date. I was not aware of any of this until I saw the bill!So since my insurance company will not help us, what should I do?Do you think a malpractice firm would take on such a small case? How can I take action and how can justice be served?
