Not Paid Last Check

Postby Eachann » Mon Jun 23, 2014 2:45 pm

Hi.

I worked as a store manager for Mr.Tire, owned by Monro Muffler and Brake. I was paid a draw against commission basis, much like a car salesman. I had a daily draw for salary, then at the end of the month, my sales commissions were figured and after my draw was subtracted, i recieved the balance at the end of the following month. when i left the company, i was still owed over $2000.00 from the previous month but they said they dont have to pay me because i wasnot employed when it was paid out the following month. it is not a bonus, it is simply the balance of my sales commission. I was not paid any hourly compensation, strictly commission. i worked upwards of 70 hours per week, usually with no lunch or breaks because alot of the time you worked in the store all day by yourself. I am in Ohio and the company is based out of Rochester NY and Baltimore Maryland. Is it leagl for them to keep my pay? Thank You
