Property Law - any help?

Property in Scotland - We returned on Christmas day just after midnight to hear running water coming from the flat upstairs & nobody was in (rented property) so we contacted the Letting agent who tried to contact the tenant, the tenant told the letting agent he had turned the water off. From this we thought due to the bad weather there may have been a burst pipe. The letting agent gave us permission to gain access to the property and said that she would accept any charges for the call out. We call the police and locksmith to gain access once entered we discovered the taps had been left on full and the stopcock had not been completely shut off so the running water we could hear was only going into the bath & sinks. We called back the letting agent and explained what had happened and she was very understanding and agreed that we could not have left as we could hear it in most of the flat and gave the address to send the invoice to.

The letting agent is now refusing to pay the invoice as there was no damage to the property, do we have any rights here?
