Providians Lawyer

Postby Kaysan » Sun Jun 01, 2014 10:18 am

providian retained a lawyer to collect a debt from me. i was served papers in oct of 04 i started paying the debt of 100.00 a month starting nov 04 since then i have been sending 100.00 to 150.00 a month for 3 1/2 years i only owed 4602.97 and when asked just a few months ago for a receipt of all my payments the balance came back as 3000.00 still owed. This lawyer Roosen from troy michigan is pocketing all the money and not putting any toward the bill. after 3 1/2 years of 100.00 to 150.00 a month payments the bill should be paid off. i have in good faith tried to pay this off but i am like alot of michiganders broke. i can't keep paying this for the lawyer to pocket and never clear my debt so i stopped paying on it in 4/08 was i wrong to quit. i have tried to report to the FTC and the attorney generals office but nothing has happened what do i do now

Sandra:

What I need to know before I answer you more fully and walk you through what to do is:

When you state "was served papers" do you mean 1) they sent demand letters through the mail and you came to this agreement 2) they filed a lawsuit against you and you came to this payment plan in exchange for the court action not going forward and the suit is just sitting dormant 3) do they have a judgment against you and the payment plan was in exchange for this collection attorney not enforcing a judgment?
