Real Estate Encroachment

Postby Archimbald » Sat Jun 21, 2014 4:39 pm

I own property in Middleton, Tn and my neighbor who has owned property next to me for about a year has encroached on my land with about 10 feet of his Mobile Home, plus a roofover, plus his water connection and partially his septic tank. I have tried to work out a deal with him but now he won't talk to me. What are my rights and what can I do. I want to use that land but canot with him on it.

Real Estate Encroachment

Martin:

The easiest and cheapest way to go about this is getting a preliminary injunction from a court barring him from encroaching on your land.  For every day that he did, it would be contempt of court.  You may also sue him in civil court for the use of your land.  You would probably need to have some sort of proof like a land survey showing that the property is in fact yours.

Unfortunately this is not something you could probably do yourself; i advise you to spend a few dollars hiring an attorney to set up the injunction for you.

Good Luck
