Relocation

Postby gervaso81 » Fri Jun 20, 2014 7:41 am

My job recently lost a contract and offered us other jobs in a different state, currently I live in VA, the custody order is in SC but I am moving to TX.  My son 14 wants to stay living with me(he was given the option to back to live with his mom - he chose no)he is very willing and wants to move to Texas he's excited about it.  My ex wife is no saying she is going to get Legal Aid to help her keep me from moving out of VA, if I do not move I will have no job and can not provide for my family. What do I need to do? I am supposed to be moving my family and belongings to Texas at the end of December after the holidays are over.

Relocation

Your ex has a legal right to ask the court to review your move to ensure it is in the child's best interest. However that would be the SC courts who would have exclusive and continuing jurisdiction unless both of your moved the jurisdiction to VA in the past or for this issue.

Usually courts don't intervene in relocation cases based on change of employment, they will modify the visitation order to ensure that the child spends time with both parents.
