Should I plead not guilty for traffic offense?

Postby gobrwy » Tue May 01, 2012 6:20 pm

I got pulled over for speeding, the officer let me go with a warning but gave me a ticket for having an expired insurance card. I had my new insurance card at home but just hadn't put it in my car yet.
I've never been in this situation before and I'm not sure what to do.
Should I plead not guilty to get the ticket price reduced? If so , how should i go about it.
I can't afford to give that amount of money right now being a kid saving for college.

Not sure what to do. Please help. Thanks!

Don't worry, if you had valid insurance at the time, they will waive any fine.

You did the crime so u should pay the fine! It's your own laziness that caused the fine so put the new card in your car start saving and pay your fine

They will most likely let you go after signing a few papers. If anything you should plea no-contest.

Yes. You are basically not guilty. As long as you can prove that your insurance was in place before you got pulled over, you should be off the hook. Look into this at your local jurisdiction level, a lot of times they allow you to simply show proof of insurance before the court date and you're off. Call the court. This saves tax payers money!

Go to your court date, give your insurance card to the court for the judge to see, make an apology to the judge and the court for failing to have your proof of insurance in the vehicle, plead guilty, and in the same breath ask for the mercy of the court. I know it sounds corny but the court judge will appreciate a decent person showing respect in his/her court for a welcome change.

I don't think you should worry but if you plead not guilty then youre going to court. Most people don't win the trial. You should've yeah kept that card in your car but I think the judge can waiver the ticket.

It depends on where you live as to whether or not the local/county police department is a bunch of douches or not. I support law enforcement but sometimes revenue raising gets in the way...That being said. (1)Call your insurance company and have them send you something (preferably faxed or if their office is near so you can get it and have it with you) such as a binder (best option)...Something that shows that you did indeed have valid insurance on that vehicle when you were pulled over.

(2) Call the # on the ticket and find out where the office is and go down there with your proof from the insurance company

(3) Ask to speak with someone from the solicitor or prosecutors office and show them what you have. They may be able to take care of it before court...Most likely you will have to go to court and show that to the judge..

(4) Its possible they will dismiss it altogether...If they are douches and still try to be technical in most jurisdictions you can do community service in lieau of having to pay a fine...where I live for instance if your fine (example is $100) they will allow you to do community service (picking up trash etc...) @ a rate of $10 an hour so 10 hours worth of community service would take care of payment of the ticket (in my example)..

Hope this helps you..good luck
