Texas Open Container

Postby Busby » Sat Jun 21, 2014 10:23 am

If a person traveling through the state of Texas(en-route to another state) is given a open container ticket(because the traveler urinated in a bottle rather than stopping and it upset the officer after smelling the bottle and learning what was in the bottle)the container was thrown to the side of the road.  What are the consequences if the person cannot go back to fight the ticket and doesn't pay the fine(the traveler is not licensed in the state of Texas)?  Would there be an expiration if a warrant was issued?

Texas Open Container

Carol,

Open container of alcohol are usually minor violations.  Failure to respond a warrant would be issued.  The warrant would not be enough for extradition.  The warrant would stay valid until the court cancelled it.  could be several years or longer.  If a bond was posted it would be forfeited.  If you were stopped traveling through Texas you would be subject to arrest and possibly lodged until the charge is answered.

Hope the helps
