Time Limit For Commencment Of Civil Suit

I filed a legal malpractice suit in Alabama.  They filed for dismissal.  The judge denied dismissal, but nothing has happened for months now.  Our civil attorney says he is waiting for the judge to issue dates for discovery, but nothing has been filed in writting that I can find, and I haven't been able to speak to him for weeks.  I'm afraid there may be some time limit for commencement of this case and if nothing gets filed the judge could dismiss.  Can this happen?  If you could give me a hint of where to look, I'll research the codes.  Please help.
